Using the "Howey test" to determine if crypto assets are or are not securities is utterly ridiculous. A court ruling from 1946 shouldn't be applied to a completely new class of assets unless the new asset meets ALL the requirements needed to justify such action. The closest requirement would be staking, which offers the opportunity to make a profit… even though this is not guaranteed. Rewards are given, but the market determines whether or not a profit is made. It hinges on whether people are buying or selling this asset, and not relying on the original owner or 3rd party to promote or maintain the asset. Control is decentralized, abd in the hands of the token holder, who can buy or sell any time they choose… often at a loss. There needs to be new regulation that's suited for the new asset it's applied to.
