It does seem like Ripple Labs the company should "seize the day" within USA so-to-speak. With the different stretched interpretation of Judge Jed Rakoff for another token, this may eventually force hand of higher court which is probably some of the hesitance of market on XRP. Taking a lesson from Collins vs FHFA and paraphrasing Justice Clarence "how do we now unscramble the egg?" I'd imagine once there is an overwhelming amount of XRP secondary market transactions history, wealth movement across borders, useful infrastructure locking in traditional institutions – SEC attempt to continually drag out lawsuits will lose traction would be my estimate.
