Celsius is paying customers back a portion of their deposits, but the payments will be in BTC and ETH. This is because of the SEC issues with Gensler. BTC and ETH are commodities. This allows Celsius to make repayments without dealing with what the SEC is calling "Securities".

George, you don’t know if they will lose if SEC gets the federal court to consider their case. Every judge will have a different option. The question is will Gary get funded by confess to take it to federal court to appeal. I don’t think so. This can’t come at the tax payers expense.
